1. About these Terms

These Terms and Conditions (the “Terms“) govern your use of https://ellsworthcrossing.com/ (the “Site“) and any purchase you make from Ellsworth Crossing, Inc. (“Ellsworth Crossing,” “we,” “us,” or “our“). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

Our Privacy Policy, Return & Refund Policy, and Shipping Policy are part of these Terms and are incorporated by reference. Where a specific policy addresses a subject in more detail than these Terms, that policy controls for that subject.

2. Who may buy from us

You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering, you confirm that you meet these requirements and that the information you provide is accurate and complete. We sell to individuals and to businesses; business information is never required to complete a purchase.

3. Products, descriptions, and availability

We sell fresh and frozen meat and other food products. We describe our products as accurately as we can, but:

Statements about sourcing and farming practices on the Site describe how we select our partner farms. They are informational and are not a warranty about any individual animal or package, except where we state a specific certification.

4. Pricing and errors

Prices are shown in U.S. dollars and do not include taxes, shipping, or delivery charges, which are calculated at checkout. We may change prices at any time, but a change will not affect an order we have already accepted.

Despite our best efforts, an item on the Site may occasionally be listed at an incorrect price or with an incorrect description. If we discover an error affecting an order you have placed, we will contact you before shipping to ask whether you want to proceed at the correct price or cancel the order for a full refund. We are not obligated to sell at an incorrect price.

5. Orders and acceptance

Placing an order is an offer to buy. The confirmation email you receive after checkout acknowledges that we have received your order; it is not acceptance of it. A contract is formed when we accept your order, which happens when we ship it or notify you that it is ready for pickup.

We may decline or cancel an order, in whole or in part, if the product is unavailable, if there was a pricing or description error, if we cannot ship to your address, if we suspect fraud or a violation of these Terms, or if the order appears to be for resale. If we cancel an order you have already paid for, we will refund you in full.

6. Payment

We accept Visa, Mastercard, American Express, and Discover. Payment is processed by our third-party payment processor; we do not store full card numbers. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us to charge the full order amount, including taxes and shipping.

If your payment is declined or reversed, we may cancel or hold your order. Applicable sales tax is calculated at checkout based on your delivery address.

7. Shipping and delivery

Full details, including where we ship, how perishables are packed, and current rates, are in our Shipping Policy. In summary:

Risk of loss passes to you on delivery to the address you provide. If your order arrives damaged, mishandled, significantly delayed, or unfit to eat, our Return & Refund Policy applies — contact us within 7 days and we will make it right.

If a delivery fails because the address you gave us was incorrect or incomplete, or because the carrier could not access the address, we may not be able to replace or refund perishable items.

8. Local pickup and local delivery

You can pick up an order at our market at 26902 W. Center Rd, Waterloo, NE 68069. Local delivery can be scheduled online or by calling 402.359.8747. Please collect pickup orders on the scheduled date; we cannot hold perishable items indefinitely and may not be able to refund items left uncollected.

9. Bulk beef orders and deposits

Whole, half, quarter, and sixteenth beef packages are made to order. These orders require a deposit of $500 and typically take approximately 3 to 4 weeks to fulfill. We will call or email you to arrange pickup or delivery.

Deposits on bulk orders are fully refundable until your order enters processing, and non-refundable afterward. Because these packages are cut and wrapped to order and cannot be resold, the final weight and the exact cuts you receive will vary. We will explain the cut sheet and how the final price is calculated before your order enters processing.

10. Returns and refunds

We stand behind everything we sell with a 100% satisfaction guarantee. Our full Return & Refund Policy is available on the Site. In summary:

Orders may be cancelled for a full refund any time before they ship or enter processing. Contact us as soon as possible and we will confirm whether your order can still be cancelled.

11. Food safety and handling

Once your order is delivered or collected, safe handling is your responsibility. Please refrigerate or freeze perishable items immediately on arrival, keep raw meat separate from other foods, and cook meat and poultry to the safe minimum internal temperatures recommended by the U.S. Department of Agriculture. Properly stored, our frozen meats can be kept for up to one year in a freezer, though we recommend using them within a few months for best quality.

Our products are prepared in facilities that handle a variety of foods. If you have a food allergy or a specific dietary requirement, contact us before ordering. We are not responsible for illness or loss resulting from improper storage, handling, thawing, or cooking after delivery.

12. Promotional codes and gift cards

Promotional codes and gift cards must be entered in the designated field at checkout before you complete your purchase. Unless we state otherwise, a promotional code applies to one order, cannot be combined with other offers, has no cash value, and may be withdrawn or expire. If you forget to apply a code, contact us as soon as possible and we will do our best to help, but we cannot guarantee that a code can be applied after an order is complete.

Gift cards are not redeemable for cash except where required by law and are not reloadable unless we say so.

If you submit a review, comment, photograph, or other content to the Site, you keep ownership of it and you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and adapt it in connection with our business, including in marketing. You confirm that the content is yours to share and does not infringe anyone else’s rights. We may remove or decline to publish content at our discretion, and we are not obligated to monitor content submitted by users.

The Site and its content — including text, product descriptions, photographs, graphics, logos, and the Ellsworth Crossing name — are owned by us or our licensors and are protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, republish, or use our content or trademarks without our written permission.

The Site may link to websites we do not control. We provide those links for convenience and do not endorse or take responsibility for their content, products, or practices.

Except for the satisfaction guarantee described in our Return & Refund Policy, and except for any warranty that cannot be excluded under applicable law, the Site and everything on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current. Some states do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any right you have under applicable consumer protection law.

To the fullest extent permitted by law, neither Ellsworth Crossing nor its officers, employees, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of or relating to your use of the Site or any product you buy from us, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or a product will not exceed the amount you paid for the order giving rise to the claim.

These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or to any other liability that cannot be limited or excluded under applicable law. Some states do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless Ellsworth Crossing and its officers and employees from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

20. Governing law and venue

These Terms and any dispute arising out of them or out of your purchase are governed by the laws of the State of Nebraska, without regard to its conflict of laws rules. You and we agree that any lawsuit will be brought exclusively in the state or federal courts located in Douglas County, Nebraska, and both of us consent to the jurisdiction of those courts. This does not deprive you of the protection of any mandatory consumer law of the state where you live.

We may update these Terms from time to time by posting the revised version on this page and updating the “Last updated” date. The Terms in effect at the time you place an order govern that order. Your continued use of the Site after a change takes effect means you accept the updated Terms.
