Ellsworth Crossing, Inc. (“Ellsworth Crossing,” “we,” “us,” or “our”) operates the website at https://ellsworthcrossing.com/ (the “Site”) and our farm-to-fork market in Waterloo, Nebraska. This Privacy Policy explains what personal information we collect through the Site, how we use and disclose it, and the choices you have.
This Policy applies to the Site and to orders placed through it. It does not apply to third-party websites or services that we link to, which have their own privacy practices. We sell to customers in the United States, and this Policy is written for U.S. residents.
By using the Site or placing an order, you acknowledge that you have read this Policy.
1. Information we collect
1.1 Information you provide to us
When you shop, create an account, contact us, or sign up for our emails, you may provide:
- First and last name
- Email address
- Phone number
- Billing address
- Shipping address
- Payment card information (credit or debit card), handled as described in Section 1.2
- Order details, including the products you buy, quantities, order history, and any delivery, pickup, or gift instructions you add
- The content of messages you send us by email or phone, including photographs you send to support a claim under our Return & Refund Policy
- Your email marketing preferences, if you subscribe
1.2 Payment card information
Payment card details you enter at checkout are transmitted to and processed by our third-party payment processor, NMI. We do not store full payment card numbers or card security codes on our own servers. We may receive and retain limited transaction information from our processor, such as the card brand, the last four digits of the card, the billing address associated with the card, the transaction amount, and whether the payment was approved or declined. Our processor handles your card information under its own privacy policy and under the security standards applicable to payment processing.
1.3 Information collected automatically
When you visit the Site, we and our service providers may automatically collect:
- IP address, and the approximate location (such as city or region) that can be inferred from it
- Browser type, language, and settings; device type and operating system
- Pages and products viewed, links clicked, search terms entered on the Site, and items added to your cart
- The page or ad that referred you to the Site, and the page you leave from
- Dates and times of your visits, and general diagnostic information about errors and performance
This information is collected using cookies, pixels, tags, and similar technologies, as described in Section 2.
1.4 Information we receive from others
- Our payment processor, which confirms transactions and may provide fraud and risk signals
- Shipping carriers, which provide tracking and delivery status for your order
- Our analytics and advertising partners, which provide information about how visitors reach and use the Site
2. Cookies, analytics, and advertising technologies
We use cookies and similar technologies for the following purposes:
- Strictly necessary — to operate the shopping cart, keep you signed in, process checkout, and protect the Site. The Site cannot function properly without these.
- Analytics — to understand how visitors find and use the Site so we can improve it.
- Advertising — to measure the performance of our advertising and to show our ads to people who have visited the Site.
- Security — to distinguish human visitors from automated abuse on our forms and at checkout.
2.1 Google Analytics
We use Google Analytics, a web analytics service provided by Google LLC, to measure Site traffic and conversions. Google Analytics sets cookies and collects identifiers and usage information about your visit, which may be transmitted to and stored by Google. We use this information in aggregate to understand which pages and products perform well and where visitors come from.
You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout, or by blocking analytics cookies in your browser.
2.2 Google Ads and remarketing
We advertise our business using Google Ads. We use Google Ads conversion tracking to measure which ads lead to orders, and we may use remarketing so that our ads are shown to people who have previously visited the Site. Google and its partners may use cookies and similar identifiers to serve ads based on your prior visits to our Site and to other sites across the internet.
You can control personalized advertising from Google through Google Ads Settings at https://adssettings.google.com. You can opt out of interest-based advertising from many participating companies at https://optout.aboutads.info and https://optout.networkadvertising.org. Opting out does not stop you from seeing ads; it limits the use of your information to personalize them.
2.3 Google reCAPTCHA
We use Google reCAPTCHA to protect our forms and checkout from spam and automated abuse. reCAPTCHA collects hardware and software information, such as device and application data, and sends it to Google for analysis. Your use of reCAPTCHA is subject to Google’s Privacy Policy at https://policies.google.com/privacy and Google’s Terms of Service at https://policies.google.com/terms.
2.4 Managing cookies
Most browsers let you refuse or delete cookies through their settings. If you block strictly necessary cookies, the shopping cart and checkout will not work. Blocking analytics and advertising cookies will not affect your ability to place an order.
3. How we use your information
We use the personal information described above to:
- Process, fulfill, ship, and deliver your orders, and arrange local pickup or local delivery
- Take payment and prevent, detect, and investigate fraudulent or unauthorized transactions
- Send you transactional messages, such as order confirmations, shipping notices, tracking updates, and responses to your questions
- Provide customer service and handle claims under our Return & Refund Policy, including reviewing photographs you send us
- Operate, maintain, secure, and improve the Site
- Measure and improve our advertising, and show you ads for our products
- Send you marketing emails about our products and promotions, if you have signed up (you can unsubscribe at any time using the link in any marketing email)
- Keep business records and comply with our legal, tax, and accounting obligations, and enforce our Terms and Conditions
4. How we disclose your information
We disclose personal information in the following ways:
- Service providers. We use vendors that perform services for us, including payment processing, order fulfillment, shipping and delivery, website hosting and maintenance, email delivery, customer support, analytics, and advertising. They receive only the information needed to perform their services for us.
- Analytics and advertising partners. As described in Section 2, our analytics and advertising partners (currently Google) receive information about your activity on the Site through cookies and similar technologies.
- Legal and safety. We may disclose information if we believe it is required by law, subpoena, or other legal process, or where we believe disclosure is necessary to protect our rights, property, or safety, or that of our customers or the public.
- Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, personal information may be transferred as part of that transaction.
- With your direction. We disclose information to others when you ask us to, such as providing your address and phone number to a carrier so it can deliver your order.
We do not disclose your personal information to unaffiliated third parties for those parties’ own independent marketing purposes, and we do not exchange your personal information for money. However, our use of analytics and advertising cookies may be treated as “selling” or “sharing” personal information under California law. Section 6 explains this and how to opt out.
5. How long we keep information
We keep personal information for as long as needed for the purposes described in this Policy. Order and transaction records are kept for as long as required to support customer service, honor our satisfaction guarantee, and meet our tax, accounting, and other legal obligations. Analytics and advertising data is retained according to the settings and default retention periods of the platforms described in Section 2. When we no longer need information, we delete it or de-identify it.
6. Your California privacy rights (CCPA / CPRA)
This section applies to California residents and describes how we handle personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”). We provide the rights described below to California residents who ask for them.
6.1 Categories of personal information we collect
In the twelve months before the effective date of this Policy, we have collected the following categories of personal information. The purposes for which we collect each category are the business and commercial purposes listed in Section 3.

We do not knowingly collect any other category of personal information listed in the CCPA, including biometric information, professional or employment information, or education information.
6.2 Sensitive personal information
The payment card information you enter at checkout may be treated as “sensitive personal information” under the CCPA. We use it only to process your payment and for the related purposes permitted by the CCPA without a right to limit — for example, to detect and prevent fraud and to keep accurate transaction records. We do not use or disclose it to infer characteristics about you, and we do not sell or share it. For that reason we do not offer a separate “Limit the Use of My Sensitive Personal Information” request. We do not collect Social Security numbers, driver’s license numbers, precise geolocation, racial or ethnic origin, religious beliefs, health information, or information about your sex life or sexual orientation.
6.3 Selling and sharing
We do not exchange personal information for money. However, the CCPA defines “sell” and “share” broadly. Our use of advertising and analytics cookies — in particular Google Ads remarketing and conversion tracking — may qualify as “selling” or “sharing” personal information for cross-context behavioral advertising. The categories that may be sold or shared in this way are Identifiers, Commercial information, Internet or other electronic network activity, Geolocation data, and Inferences, and the recipients are our analytics and advertising partners. You can opt out as described in Section 6.5.
We do not sell or share the personal information of consumers we know to be under 16 years of age.
6.4 Your rights
Subject to verification and to exceptions in the law, California residents have the right to:
- Know and access — request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we disclosed it
- Delete — request that we delete personal information we collected from you
- Correct — request that we correct inaccurate personal information we maintain about you
- Opt out of sale or sharing — direct us to stop selling or sharing your personal information as described in Section 6.3
- Non-discrimination — not be denied goods or services, charged a different price, or given a different level of quality because you exercised a privacy right
Some requests may be denied in whole or in part where the law allows — for example, we will keep the records of a completed transaction that we need in order to comply with tax and accounting requirements, even if you ask us to delete your other information.
6.5 How to submit a request
You, or an authorized agent acting on your behalf, may submit a request by emailing localfarmdirect@gmail.com or calling 402.359.8747. Please tell us which right you are exercising and give us enough information to find your records — typically the name, email address, and phone number used on your order.
We will confirm receipt of your request within 10 business days and respond within 45 days. If we need more time, we will tell you and may take up to an additional 45 days. To protect your information, we will verify your identity before acting on a request to know, delete, or correct — usually by asking you to confirm details that match what we already have on file, such as an order number and the email address used to place it. We will not fulfill a request we cannot verify. An authorized agent must provide written permission signed by you, and we may still contact you directly to confirm.
There is no charge to make a request, and exercising your rights will not affect the price or quality of anything we sell.
6.6 “Shine the Light”
California Civil Code § 1798.83 permits California residents to request information about disclosures of personal information to third parties for those third parties’ own direct marketing purposes. We do not make those disclosures.
7. Opt-out of targeted advertising
We use Google Analytics and Google Ads on the Site. These services use cookies and similar technologies and may be used to show you ads based on your visits to this Site and other sites online.
You can limit this in these ways:
- Opt out of personalized Google ads through Google’s Ads Settings and opt out of Google Analytics using Google’s browser add-on (Sections 2.1 and 2.2).
- Use the industry opt-out tools listed in Section 2.2.
- Block or delete advertising and analytics cookies in your browser settings.
Because these opt-outs are stored in your browser, you will need to opt out separately in each browser and on each device you use, and again if you clear your cookies.
8. California Online Privacy Protection Act (CalOPPA) disclosures
8.1 Do Not Track signals
Some browsers transmit a “Do Not Track” (“DNT”) signal. There is no common industry standard for how to interpret DNT signals, and the Site does not currently respond to them. You can still limit tracking using the browser controls and opt-out tools described in Sections 2 and 7.
8.2 Third-party collection across websites
Yes — third parties may collect personally identifiable information about your online activities over time and across different websites when you use our Site. Specifically, our analytics and advertising partners described in Section 2 (currently Google) may do so through cookies and similar technologies.
8.3 Reviewing and changing your information
If you have an account, you can review and update your name, email address, phone number, and saved addresses by signing in and visiting your account page. You can also email us at localfarmdirect@gmail.com or call 402.359.8747 and we will help you review, correct, or remove the information we hold about you.
8.4 How we notify you of changes
We will post any changes to this Policy on this page and update the “Last updated” date at the top. See Section 12.
9. Residents of other U.S. states
Several other states have enacted consumer privacy laws that give residents rights similar to those described in Section 6, such as the right to access, correct, delete, or obtain a copy of personal information, and to opt out of targeted advertising. These laws differ in whether and how they apply to a business of our size. If you are a resident of one of these states and would like to make a request, contact us using the details in Section 14 and we will respond consistent with applicable law.
10. Security
The Site is served over HTTPS, and payment card information is transmitted directly to our payment processor over an encrypted connection. We take reasonable measures designed to protect the personal information we hold. However, no method of transmitting information over the internet and no method of electronic storage is completely secure, and we cannot guarantee the absolute security of your information. You are responsible for keeping your account password confidential.
11. Children’s privacy
The Site is intended for adults. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.
12. Changes to this Privacy Policy
We may update this Policy from time to time. When we do, we will post the revised Policy on this page and change the “Last updated” date at the top. If we make a material change in how we use personal information we have already collected, we will provide a more prominent notice, such as a notice on the Site or an email to the address associated with your account. Your continued use of the Site after a change takes effect means you are aware of the updated Policy.
13. Links to other websites
The Site may link to websites we do not operate, including social media platforms and our payment processor. We are not responsible for the privacy practices of those websites, and this Policy does not apply to them. We encourage you to read the privacy policy of any website you visit.
